Significant Data Fiduciaries

In plain English

The Central Government may notify a Data Fiduciary or class of them as Significant Data Fiduciaries, weighing the volume and sensitivity of data, the risk to Data Principals' rights, the effect on India's sovereignty and security, and on democracy and public order. A Significant Data Fiduciary must appoint a Data Protection Officer based in India who answers to its board, appoint an independent data auditor, and carry out periodic data protection impact assessments and audits. Rule 12 adds an annual audit and algorithmic due diligence, and lets the Government restrict the transfer of specified data outside India.

What you must do

  • If notified as a Significant Data Fiduciary, appoint a Data Protection Officer based in India who reports to the board of directors or a similar body.

  • Appoint an independent data auditor and run the periodic impact assessments and audits Rule 13 requires.

  • Check your algorithms do not pose a risk to Data Principals' rights, and keep the data the Government specifies within India.
