Consent Managers

In plain English

Creates the registration regime for Consent Managers, the platforms through which a person can give, manage, review and withdraw consent across many Data Fiduciaries. A company that meets the conditions in Part A of the First Schedule (incorporated in India, net worth of at least Rs 2 crore, sound management, independence from Data Fiduciaries, certified interoperable platform) may apply to the Board, which can inquire, register or reject with reasons, and must publish registered Consent Managers on its website.

Registered Consent Managers carry the obligations in Part B of the First Schedule. The Board can direct a Consent Manager to fix non-adherence, and after a hearing can suspend or cancel its registration and give directions to protect Data Principals. It can also call for information.

What you must do

  • If you plan to operate a Consent Manager, check the Part A conditions now; registration opens 13 Nov 2026 and the Board publishes the application particulars on its website.

  • If you are a Data Fiduciary, prepare to receive consent given through a registered Consent Manager and to honour withdrawals routed through it (s. 6(7) of the Act).

  • Expect published particulars of registered Consent Managers on the Board's website; only those count as Consent Managers under the Act.

Note

Rule 4 is the one Rule with its own commencement date, one year after the Rules were published. Everything else that binds companies starts six months later, on 13 May 2027.
